LEECHGUARD TERMS OF SERVICE

These Terms of Service ("Terms") govern your use of the LeechGuard application and associated services ("Service"), operated by Watchwise LLC ("we," "us," or "our"). By accessing or using LeechGuard, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. Data Storage and Privacy
LeechGuard is a cloud-connected service. Your account data — including protected asset records, monitored channels, scan results, detected infringements, takedown requests, face profiles, and audit logs — is stored securely on our cloud infrastructure (currently Supabase) and is accessible only to your authenticated account.
We do not sell, share, or monetize your personal data with third parties for advertising or data-brokering purposes. Data is shared only with service providers necessary to operate the platform (see Section 6).
You may request deletion of your account and associated data at any time through the app. Upon verified deletion, your personal data is permanently removed from our systems within 30 days, except where retention is required by law.
2. Biometric and Face Data
LeechGuard's face monitoring feature processes facial recognition data, which may constitute biometric information under applicable law (including Illinois BIPA, Texas CUBI, and EU GDPR).
By enabling face monitoring, you:
Confirm that any reference photo you submit is a photo of yourself or a person for whom you are the authorized legal representative
Consent to your reference image being processed by third-party facial recognition services (AWS Rekognition, FaceCheck.ID) for the sole purpose of identifying unauthorized uses of your likeness
Acknowledge that your reference image is stored in your account and used only for matching purposes — it is never used for advertising, sold to third parties, or shared beyond the services listed in Section 6
Understand that you may delete your face profile at any time, which permanently removes the reference image and ceases all face-based scanning
We do not retain biometric identifiers beyond the term of your account. We do not sell biometric data under any circumstances.
3. User-Authorized Scanning
By initiating a scan, you authorize LeechGuard to access publicly available web pages, public image search APIs, reverse image search services, and public records to identify potential unauthorized uses of your registered content and likeness.
You confirm that:
You own or are the authorized representative of all content and identities you register for protection
You will not use LeechGuard to scan content or identities you do not have rights over
You understand LeechGuard scans only publicly accessible content and does not bypass authentication, CAPTCHA protections, paywalls, or any access controls
You will not use LeechGuard for harassment, stalking, or any purpose other than protecting your own intellectual property and likeness rights
4. Takedown Notices and Legal Enforcement
LeechGuard provides tools to draft and send copyright takedown notices (DMCA 17 U.S.C. §512) and right-to-erasure requests (GDPR Art. 17 / DSA Art. 17) on your behalf.
Your responsibility: All notices sent through LeechGuard are submitted in your name and under your authority. You are responsible for ensuring that:
The content you identify as infringing is genuinely unauthorized
The information in each notice is accurate to the best of your knowledge
You have the legal right to assert the copyright or privacy claim being made
Submitting a knowingly false takedown notice may expose you to liability under 17 U.S.C. §512(f) and applicable law. LeechGuard does not provide legal advice and is not responsible for the legal outcomes of notices sent through the platform.
5. Quiet Mode — Automated Enforcement Authorization
Quiet Mode is a premium feature that authorizes LeechGuard to act as your designated representative to initiate scans, send legal notices, and follow up on deadlines automatically, without requiring your approval for each action.
By enabling Quiet Mode, you:
Grant LeechGuard limited written authorization to send copyright takedown notices and right-to-erasure requests on your behalf
Confirm you are the rights holder or authorized agent for all protected assets in your account
Acknowledge that all notices sent in Quiet Mode are submitted under penalty of perjury in your name
Agree to review any legal action notifications promptly
Understand this authorization is logged with your user ID and timestamp and is revocable at any time by disabling Quiet Mode
This authorization does not transfer ownership of any rights or intellectual property to LeechGuard. Revoking Quiet Mode stops future automated sends; it does not retract notices already sent.
6. Third-Party Services
LeechGuard integrates the following third-party services to deliver its functionality. By using LeechGuard, you acknowledge that your data may be processed by these services as described:

We do not share data with these services beyond what is necessary to perform the stated function.
7. Subscriptions and Payments
LeechGuard offers free and paid subscription tiers. Paid features are billed through the Apple App Store or Google Play Store, processed by RevenueCat.
Subscriptions automatically renew unless cancelled at least 24 hours before the end of the billing period
You may manage or cancel subscriptions through your App Store or Google Play account settings
We do not process payment information directly — all billing is handled by Apple or Google under their respective terms
Refunds are subject to Apple's and Google's refund policies
8. Adult Content
LeechGuard may scan adult content platforms (including leak sites and adult aggregators) when you have enabled adult content alerts. By enabling this setting, you confirm you are 18 years of age or older.
LeechGuard does not generate, host, or distribute adult content. Thumbnails from adult platforms are suppressed and never stored.
9. Prohibited Uses
You may not use LeechGuard to:
Scan, monitor, or pursue takedowns for content or identities you do not own or represent
Harass, stalk, or surveil any individual
Submit knowingly false or misleading takedown notices
Attempt to reverse-engineer, scrape, or misuse the LeechGuard platform or its APIs
Violate any applicable law or third-party terms of service
Violations may result in immediate account termination.
10. Limitation of Liability
To the maximum extent permitted by applicable law, Watchwise LLC shall not be liable for:
The outcome of any takedown notice, legal action, or counter-notice
Failure to detect infringing content
Data loss resulting from device failure or account deletion
Any indirect, incidental, or consequential damages arising from use of the Service
Our total liability to you for any claim arising from these Terms shall not exceed the amount you paid us in the 12 months preceding the claim.
11. Governing Law
These Terms are governed by the laws of the State of Michigan, United States, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Michigan.
12. Amendments
We may update these Terms to reflect changes in the Service or applicable law. We will notify you of material changes through the app or by email. Your continued use of LeechGuard following notice of changes constitutes your acceptance of the updated Terms.
